Who's writing this guide?

I’m Brad Esposito with Family Property Buyers in St. Charles. If you’re behind on payments, the first call is to a housing counselor or an attorney, not to me. Here’s what I’d want you to know.

How does foreclosure work in Illinois?

Illinois foreclosure goes through the courts. Illinois Legal Aid Online explains that a foreclosure generally can’t be filed unless more than 120 days have passed since you stopped paying, and that you may be able to go through loss mitigation with your lender.

What if you’ve been served?

Illinois Legal Aid Online’s foreclosure process guide says a Homeowner Notice explaining your rights, including reinstatement and redemption, must come with the summons, and that defendants generally must file an appearance and answer within 30 days of service. Don’t ignore the papers. In Kane County, foreclosure cases are heard at the Kane County Courthouse, 100 S. Third St., Geneva.

Who helps for free?

A HUD-approved housing counselor can review your budget and talk to your lender about options at no cost. Illinois Legal Aid Online lists legal help resources.

Is there foreclosure mediation in Kane County?

Kane County’s court-run residential foreclosure mediation program has ended. The 16th Judicial Circuit’s local rule for the program was repealed effective April 17, 2023. In general, mediation means a neutral person helps you and your lender talk through options. A HUD-approved housing counselor or an attorney can tell you whether your lender offers loss mitigation or any other review for your loan.

When does selling make sense?

If keeping the house isn’t realistic, a sale can pay off the loan at closing, and the title company confirms the payoff. Selling before a court sale can leave you more say in how and when you move. Talking with me doesn’t pause or stop a foreclosure case. Keep working with your counselor, your lender and your attorney. An attorney can tell you how a sale fits your case.

What if selling is the cleaner path?

If you decide to sell, the house can stay as it is.

We buy as-is: no showings, no repairs needed. Selling directly to us means you don’t list with an agent.

We can often cover closing costs. Every cost explained up front, before you sign anything.

How do you check out any cash buyer before you sign?

  • Get the offer in writing. It should show the price and who pays which costs.
  • Read the whole contract. Ask about any line you don’t understand before you sign.
  • Have your own attorney. An Illinois real estate attorney can review the contract for you.
  • Check that the business is registered. You can look it up on the Illinois Secretary of State business search.
  • Don’t pay upfront fees. You shouldn’t have to pay anyone just to sell your house.
  • Ask about your right to cancel. Illinois law gives owners behind on a mortgage or taxes extra protections in some sales. An attorney can tell you what applies to you.

This is general information, not legal advice. Talk to an Illinois attorney about your situation.
