Tired of Being a Landlord in Kane County? How to Sell a Rental

You can sell a rental with tenants still in it. In Elgin, rental licenses don’t transfer when a property sells, so the buyer handles a new license. Start by reading your leases.

Who's writing this guide?

I’m Brad Esposito with Family Property Buyers in St. Charles. I buy rentals across Kane County, with or without tenants. Here’s what I’d want you to know before you decide.

Can you sell with tenants in place?

Often, yes. Existing leases usually carry over to the new owner, so read each lease first and talk to an attorney about notice, security deposits and timing. Don’t change locks, cut utilities or pressure a tenant to leave. Ending a tenancy follows Illinois law and the lease.

What about Elgin’s rental license?

Elgin requires a license for rental residential property. The city’s Rental License page says licenses are not transferable when a property is sold, and a new owner has 30 days from closing to apply. The city’s Rental License Program Overview covers inspections, and its Landlord Training Program is mandatory for license holders. Other Kane County towns have their own rules, so check with your city or village.

What do you hand over at closing?

Usually copies of current leases, a rent roll, security deposit amounts, and any open city notices. Your attorney and the title company handle the transfer of deposits and prorated rent.

Which offices matter?

Taxes go to the Kane County Treasurer, Geneva. Your township assessor is on the Kane County township assessor list. Eviction and other civil cases are heard at the Kane County Courthouse, 100 S. Third St., Geneva.

What if selling is the cleaner path?

You don’t have to turn over or rehab the unit first.

We buy as-is: no showings, no repairs needed. Selling directly to us means you don’t list with an agent.

We can often cover closing costs. Every cost explained up front, before you sign anything.

How do you check out any cash buyer before you sign?

  • Get the offer in writing. It should show the price and who pays which costs.
  • Read the whole contract. Ask about any line you don’t understand before you sign.
  • Have your own attorney. An Illinois real estate attorney can review the contract for you.
  • Check that the business is registered. You can look it up on the Illinois Secretary of State business search.
  • Don’t pay upfront fees. You shouldn’t have to pay anyone just to sell your house.
  • Ask about your right to cancel. Illinois law gives owners behind on a mortgage or taxes extra protections in some sales. An attorney can tell you what applies to you.

This is general information, not legal advice. Talk to an Illinois attorney about your situation.

What happens if you reach out to us?

What do Kane County landlords ask me?

Can I sell my rental with tenants living there?

Often, yes. Leases usually carry over to the new owner. Read your leases and talk to an attorney first.

Does an Elgin rental license transfer to the buyer?

No. Elgin says licenses are not transferable when a property is sold. A new owner has 30 days from closing to apply.

Do I have to fix up the rental before selling?

No. We buy as-is, with no showings and no repairs needed.

What paperwork should I gather?

Current leases, a rent roll, security deposit records, and any open city notices.

Who handles security deposits at closing?

Your attorney and the title company. Ask your attorney what Illinois law requires for your property.
