Where is probate filed in DuPage County?

Probate cases are handled by the DuPage County Circuit Court. The Circuit Court Clerk’s office is at 505 N. County Farm Road, Wheaton, open 8:00 a.m. to 4:30 p.m., Monday through Friday, except court holidays. Its Civil Department number is (630) 407-8700. Illinois law says probate is filed in the county where the person lived. If they had no Illinois home, it’s filed where most of their Illinois real estate is (755 ILCS 5/5-1). If the owner lived outside DuPage, ask a probate attorney where to start.

What do I do with the will?

Illinois law says that right after a death, whoever has the will must file it with the clerk of the court in the proper county (755 ILCS 5/6-1). A person named as executor has 30 days after learning of it to start probate or say they won’t serve (755 ILCS 5/6-3). An attorney can tell you what applies to your family.

Can a small estate affidavit transfer the house?

Illinois law describes the small estate affidavit as a way to transfer personal property, when no probate case is open or planned and the personal estate is $150,000 or less, not counting most vehicles registered with the Illinois Secretary of State (755 ILCS 5/25-1). Starting Jan. 1, 2027, motor homes, campers, trailers and some other vehicles count toward that limit. A house is real estate, so don’t assume the affidavit lets anyone sell it. Ask an Illinois probate attorney what your family needs before you sign a contract.

Who can sign the deed?

In probate, the court appoints a representative. Under Illinois law, an independent representative can usually sell the decedent’s real estate without a court order, unless the will says otherwise, but real estate left to a specific person in the will can’t be sold without that person’s written consent (755 ILCS 5/28-8). When the deed is ready, the DuPage County Recorder’s FAQ lists what it needs to record it, and the Recorder is on the first floor at 421 N. County Farm Road, Wheaton, (630) 407-5400 (contact page).

What about taxes and bills while probate runs?

Property taxes keep coming. DuPage tax bills go to the DuPage County Treasurer, and the Treasurer holds the annual tax sale if taxes go unpaid. Keep the utilities, insurance and lawn care going if you can, and ask your attorney which estate account should pay them. If family members disagree, our guide on siblings who disagree about an inherited house may help.

What if selling is the cleaner path?

You don’t have to clean out the house or fix anything first.

We buy as-is: no showings, no repairs needed. Selling directly to us means you don’t list with an agent.

We can often cover closing costs. We explain every cost up front, before you sign anything.

How do you check out any cash buyer before you sign?

  • Get the offer in writing. It should show the price and who pays which costs.
  • Read the whole contract. Ask about any line you don’t understand before you sign.
  • Have your own attorney. An Illinois real estate attorney can review the contract for you.
  • Check that the business is registered. You can look it up on the Illinois Secretary of State business search.
  • Don’t pay upfront fees. You shouldn’t have to pay anyone just to sell your house.
  • Ask about your right to cancel. Illinois law gives owners behind on a mortgage or taxes extra protections in some sales. An attorney can tell you what applies to you.

This is general information, not legal advice. Talk to an Illinois probate attorney about your situation.
